BUXTON & VIRGIN EXPERIENCE SOCIAL COMPETITION FULL TERMS AND CONDITIONS 

 

These Terms and Conditions (the Terms and Conditions) prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry instructions are deemed to form part of the Terms and Conditions and by entering this promotion all participants will be deemed to have accepted and be bound by the Terms and Conditions. Participants should retain a copy for their information. 
 

The Promoter takes data protection seriously. By entering in this promotion, participants confirm that they have read the Privacy Policy, and agree to these Terms and Conditions of the promotion. By submitting any information / content required as part of their participation into the promotion, participants agree to their information being held and processed in accordance with the General Data Protection Regulation (GDPR) and the Data Protection Act 2018.

The Promotion: 

 

  1. The promotion is open to legal residents of United Kingdom (England, Scotland, Wales, and Northern Ireland), Channel Islands and Isle of Man, excluding employees (and their immediate families) of the Promoter, affiliated companies, agents, or anyone else professionally connected with the promotion. 
     

  1. Entrants must be 18 years or over. 
     

  1. Entrants must have access to the Internet. 
     

  1.    A valid Facebook, Instagram or Twitter account and access to the internet is required. Participants who do not have a Facebook, Instagram, or Twitter account, will need to create one in order to participate. An active email address is required to do this. All entries will be subject to the Terms of Service for Instagram, Facebook and Twitter which are available online at www.instagram.com, www.facebook.com and www.twitter.com
     

  1.    The entrant entering the promotion must be the owner of the Facebook, Instagram or Twitter account used. Proof of ownership of the social media account and proof of age may be required. 
     

  1. Any entries received from private accounts will not be entered due to privacy restrictions. To enter from a private account participants must amend their account settings to a public account in order for their entry to be accepted. The account must remain public during the promotion and for 14 days after the end of the promotion to enable the Promoter to contact the entrant in the event of their entry being a winner.  
     

  1. Maximum one entry per platform per person during the promotional period.  
     
     

  1. Failure to comply with any part of these clauses will disqualify the respective entry from the promotion. 
     

  1. No purchase is required to enter the promotion. 

 

Promotional Period 

 

  1. The prize draw entry period for a chance to win one (1) £250 Virgin Experience voucher opens at 00.00 on 3rd August 2022 and closes at 23.59 on 10th August 2022.  
     

  1.  Any entries received outside of these times and dates or deemed not to be of suitable standard as detailed in the “content”, will not be included in the prize draw, and will not have a chance to win a prize.

Participants should not tag another person without their express permission to do so.  

 

  1. Entries (bulk or otherwise) made from trade, consumer groups, aliases, agents or third parties will not be accepted. Incomplete or illegible entries, entries by macros or other automated means (including systems which can be programmed to enter), and entries which do not satisfy the requirements of these Terms and Conditions in full will be disqualified and will not be counted. If it becomes apparent that an entrant is using a computer(s) to circumvent this condition by, for example, the use of ‘script’, ‘brute force’, masking their identity by manipulating IP addresses, using identities other than their own or any other automated means in order to increase that entrant’s entries into the promotion in a way that is not consistent with the spirit of the promotion, that entrant’s entries will be disqualified and any prize award will be void. 
     

  1. Obscene, distasteful, or inappropriate entries will not be accepted. Entrants are solely responsible for the content they provide, and any views highlighted in the content. Only genuine, valid moderated content will be entered into the promotion that respects the guidelines, key messages, and philosophy of Buxton Water i.e., responsible marketing checks and the codes of practice https://www.buxtonwater.co.uk/terms-and-conditions) 

 

  1. Moderation: By participating, entrants understand and agree to their comments for this promotion being publicly displayed. Such entries may be attributed to the original entrant using their name as provided with their entry or as shown on their account. Entries will be strictly monitored by the Promoter. The Promoter and their agents reserve the right to reject any entries for any reason in their sole discretion and the Promoter will reject entries which, in the reasonable opinion of the Promoter: 

  1. Contains any content that is offensive or could reflect negatively on the name, reputation, or goodwill of the Promoter or any brand partner; 

  1. Includes trademarks, logos, or copyrighted material not owned by the entrant or used without the right holder's prior written permission (including famous names, company names, etc.); 

  1. Defames, misrepresents, or contains Content for the intended purpose of harassing, threatening or embarrassing individuals or multiple individuals or insults other people or companies, including, but not limited to the Promoter (including its partners);  

  1. Promotes any political, blasphemous or religious agenda or any image deemed to incite religious hatred; 

  1. Is deemed to be distasteful, degrading or will in any way cause offence: 

  1. Contains images of third parties who have not expressly consented to feature in promotion; 

  1. Contains any images of children; 

  1. Is a duplicate entry; 

  1. Any Instagram, Facebook or Twitter name or profile photograph which contravenes the above will be void, and any entries will not count; 

and 

  1. Any entry that contains any computer viruses, worms, Trojan horses or other potentially damaging computer programs or files. 

 

  1. Comments should not imply, mention, or tag another person except where the entrant has obtained express permission to publicly share their image or platform name. All entries must conform to Instagram, Facebook and Twitter guidelines and terms and conditions. 
     

  1. The Promoter and their agents reserve the right, but not the obligation, to monitor and review the content submitted, and to remove or refuse to take forward as an entry any content submitted that the Promoter does not deem, in its sole discretion, to be appropriate, or which the Promoter deems to violate any of these Terms and Conditions.  
     

  1. All entries will be strictly monitored by the Promoter and their third-party adjudicators throughout and any attempts to manipulate or otherwise unfairly influence the prize draw will result in disqualification of entry or suspension of the promotion. 
     

  1. The Promoter reserves the right to report any content violations to the appropriate authorities. 
     

  1. The Promoter does not guarantee that you will have any recourse to edit or delete any Content you have submitted. You acknowledge that you, not the Promoter, are responsible for the Contents of your submission. None of the Content that you submit shall be subject to any obligation of confidence on the part of the Promoter, its agents, subsidiaries, affiliates, or third-party service providers and their respective directors, officers and employees. The person who uploaded the comment is the individual who is entered into the Prize Draw and the entrant confirms that s/he has obtained any and all releases and consents if relevant of third parties necessary to permit the submission for the purposes of this prize draw in the manner set forth in these Terms and Conditions without additional compensation.  

 

The Prize: 

  1. One Digital £250 Virgin Experience Days voucher that can be redeemed on over 1,000 experiences at www.virginexperiencedays.co.uk
     

  1. The digital voucher must be used on an experience by 01.08.23. 

 

  1. The £250 Virgin Experience Days e-gift card codes can be used in conjunction with any other discount code.  
     

  1. To redeem the £250 e-gift card code at www.virginexperiencedays.co.uk, the winner may choose their experience/experiences and click through to ‘My Basket’. When they are you’re happy with their choice, ‘Check Out’ and complete the delivery and packaging options, here winners should select to ‘add a gift card’ under the payment section and then ‘Finish & Pay’. The e-gift card value will be deduced from their total basket cost. Should the value of the basket be more than £250 then the winner must  pay the balance. If the chosen activity is less than £250, any left over balance will remain on the original e-gift card. The gift card can be used until the available balance has cleared or the valid date expires, whichever is sooner.  

 

  1. Each Virgin Experience Day purchase will have its own validity stated on the experience at www.virginexperiencedays.co.uk and can be seen prior to the purchase under the additional details section. Booking dates are held with the supplier and stated on the website pre-purchase.

Winner Selection & Notification / fulfilment 

  1. There will be one winner selected at random by an independently audited computer programme from all valid and suitable entries received via a post/comment on the official Buxton Instagram, Facebook, or Twitter pages by the closing date. The winner will be selected at random from the three social media platforms but checked to ensure the correct criteria are met.  
     

  1. The winner will be contacted via a message under their original entry on Instagram, Facebook or Twitter within three (3) standard working days of the closing date informing them to direct message the Promoter. Thereafter, the winner will be contacted and will be required to respond to confirm eligibility and provide address information for the fulfilment of their prize. 
     

  1. Inaccurate information may result in the prize being forfeited. In the event the winner does not respond to communications within the three (3) days of initial contact, or is disqualified after verification checks, the Promoter reserves the right to withdraw and withhold the prize from this potential winner and allocate that prize to an alternative winner selected next in line as a reserve at the same time as the original. This process will continue through the reserves or until 31.08.2022 when if no winner has claimed the prize, it will be withdrawn completely.  

  1. On completion of the validation process, details regarding the delivery which will occur via the winner’s informed email address will be confirmed, and the prize will be despatched within 28 days of verification to the confirmed winner. 

 

 

GENERAL  

  1. Anyone, who in the Promoter’s absolute discretion, is acting in a manner that undermines the operation and integrity of the promotion or in any way which gives an unfair advantage will be disqualified and any persons seeking to use such information gained will be disqualified. The Promoter reserves the right to verify all entries including but not limited to asking for address and identity details (which they must provide within 14 calendar days) 
     

  1. Limitations of liability: insofar as permitted by law, the Promoter does not assume any responsibility for: 

  1. Any faulty, incorrect, failed or erroneous electronic data transmissions. 

  1. Communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computer or provider utilised in any aspect of this promotion. 

  1. Entries lost, damaged or delayed. Proof of sending will not be accepted as proof of receipt 

  1. Inaccessibility or unavailability of the internet, or any website/social media site, or any combination thereof. 
     

  1. All normal Internet connection charges associated with the submission of an entry to the promotion shall be the entrant's responsibility. 
     

  1. If for any reason the promotion is not capable of running as planned for reasons including but not limited to tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right (subject to any written directions given under applicable law) to disqualify any individual who tampers with the entry process and to cancel, terminate, modify or suspend the promotion or invalidate any affected entries but will endeavour to minimize the effect to entrants in order to avoid undue disappointment. 
     

  1. The prize is not transferable or exchangeable unless otherwise stated.  
     

  1. By entering the promotion, the winner agrees that the Promoter may contact them to ask whether they want to participate in publicity relating to the promotion for which their consent will be required. 
     

  1. The contents of all entries submitted become property of the Promoter. The Promoter reserves the right to use the contents of entry submissions provided by entrants, for editorial, advertising, marketing and promotional purposes, without further compensation or notice, unless prohibited by law. Each Eligible entrant grants permission for Promoter to use the contents of their entry submission for editorial, advertising, marketing and promotional purposes in any and all media now known or hereafter discovered, worldwide, in perpetuity, without compensation, notification or permission. Participants agree not to assert any moral rights in relation to such use where the moral rights in respect of the content, are theirs to assert. Participants warrant that the materials contain no copyright materials, are their original works, have not been copied, in whole or in part, from any third party and they have full authority to grant these rights. 
     

  1. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion or accepting or using the prize, except for any liability which cannot be excluded by law (including personal injury, death and fraud) in which case that liability is limited to the minimum allowable by law. 
     

  1. This promotion is in no way sponsored, endorsed, or administered by, or associated with Instagram, Facebook, or Twitter. The entrant accepts/understands that they are providing their information to the Promoter, and that Instagram, Facebook or Twitter have no liability for any element of this promotion.   1. By entering this promotion, all participants will be deemed to have accepted and be bound by these Terms and Conditions.

Subject to the Promoter’s Privacy Policy, the surnames and counties of residence of the winner will be made available on request from the draw date for a minimum of three months, by sending an email titled: “BUXTON WATER Rise Up and Win Social Media Winner’s List” to: [email protected]. When contacting this email address, your request will be actioned in line with Nestlé’s Privacy Policy. The Promoter reserves the right to refuse any or all such requests. If any winner objects to their information being published, then they can contact the Promoter by emailing [email protected]  We may nevertheless disclose the information to the Advertising Standards Authority if required to do so. 
     

  1. The Promoter shall have sole and final determination as to which entries are genuine and therefore eligible to take part in this promotion. The Promoter’s decision is final and binding. 

  1. Any person posting, or seen to be posting, comments to the Promoter’s social media pages or elsewhere during the promotion that are considered bullying, spiteful or upsetting to other participants, fans of the Promoter or directly aimed at the Promoter, will have their comments removed and will be disqualified from the promotion.  
     

  1. If any provisions of these Terms and Conditions are judged to be invalid, illegal, or otherwise unenforceable, then its shall be severed and deleted from these Terms and Conditions and the remaining clauses shall survive and remain in full force and effect.  
     

  1. The Promotion and these Terms and Conditions will be governed by the laws of the participating country but any disputes as to the meaning of these Terms and Conditions will be subject to the exclusive jurisdiction of the participant’s local.

Data Protection: The Promoter will only use the personal details supplied for the administration of the promotion and the auditing of the entries where necessary and for no other purpose, unless we have your consent/you have opted-in to receive future marketing communications. Eligibility 

  1. The 12 month Headspace E-Gift Card prize draw (the “Promotion”) is only open to UK (England, Wales, Scotland and Northern Ireland), Isle of Man and Channel Islands residents aged 18 or over who are newly registered members of the Buxton Vitality Club (registered between 01.07.22 to 31.08.22). Participants must have ticked to confirm entry into the prize draw as part of sign up. 

  1. The promotion excludes employees and the immediate families of (Nestlé Waters UK Ltd) (“the Promoter”), its affiliated companies, agents or anyone else professionally connected to the promotion 

  1. Internet access to the promotional website, sign up to Buxton Vitality Club and confirmation of entry to the prize draw required. 

  1. Participation in the draw is only possible via the official site where the correct information is given as part of the Club sign up process between 01.07.22 and 31.08.22, including first name, last name, and a genuine personal email account plus confirmation of entry into the draw. 

  1. Only one entry per member throughout the duration of the Promotion.   

  1. All entries into the Headspace E-Gift Card prize draw must be submitted by the entrant in a personal capacity on their own behalf. Entries submitted via third parties, agents, organised groups, syndicates, aliases or in bulk are prohibited, and the Promoter reserves the right to refuse to award the prize where it reasonably suspects that an entry was submitted by such means. Any person trying to circumvent the entry process by any method (e.g., by using multiple names, phones, address, or IP) will be disqualified (along with their household and any other associated entries) for the duration of the Promotion. 

 
 
Promotional Period 

  1. The Promotion is open for entries between 00.00 on 01.07.22 and 23:59 on 31.08.22 with all valid and correct entries going into the draw. 
     

  1. Entries received outside of this promotional period will not be included in the prize draw. 
     
    How to enter 

  1. To enter the prize draw, for a chance to win one of two Headspace E-Gift card, participants must: 

  1. Complete and confirm all details relating to the sign up as a new member for the Buxton Vitality Club between the required dates. 

  1. Enter full name and email address as part of this process. 

  1. Tick the confirmation box to entry the prize draw. 

Successful entries will be confirmed via an on-screen message. 
 

  1. No incomplete or corrupted entries will be accepted. In this event, the person's entry will be disqualified, and any prize award will be void. Any malicious or manipulative attempt to influence the awarding of the prize will result in disqualification at the sole discretion of the Promoter. If there is any reason to believe that there has been a breach of these Terms and Conditions or incorrect, illegible, fraudulent, or other invalid or improper information has been provided the Promoter may at its sole discretion refuse to fulfil the prize. 
     

  1. The Promoter reserves the right to verify the eligibility of entrants. The Promoter may require such information as it considers reasonably necessary for the purpose of verifying the eligibility of an entry and the prize may be withheld until and unless the Promoter (in its sole discretion) is satisfied with the verification.  
     

  1. Only one genuine acceptable entry per person/new member. 
     

  1. Entry into the prize draw is automatic upon completion of the various details mentioned above. It is the responsibility of the entrant to provide correct, up-to-date details when entering the promotion.  The Promoter cannot be held responsible for entrants failing to supply accurate information which affects fulfilment of their prize.  

   

  1. No responsibility will be accepted for entries which are incomplete, incorrectly completed, illegible, invalid, not received for whatever reason or for any technical or other error that may arise with any entry. 
     
    Prize Details  
     

  1. There are two 12 month Headspace E-Gift cards to be won worth £9.99 per month. No one person may win more than one prize.  
     

  1. The prize is non-negotiable and non-refundable. No cash alternative is offered in whole or in part. The Promoter reserves the right to substitute the prize, or part of the prize for an item of equal or greater value due to circumstances outside of the Promoter's control should any element of the prize be unavailable. Unless otherwise agreed in writing by the Promoter, the prize will only be awarded directly to the winner.  

Winner selection and notification 

  1. Two winners will be drawn at random within seven (7) working days of the closing date by an independent auditor from all valid and genuine entries.   

  1. Participants are encouraged to monitor their email account including junk/spam folders during this time in case they are the winner.  
     

  1. The winners will be notified via email within seven (7) days of the draw date using the email address included in their original entry to confirm their win (subject to verification) and for the Promoter to collect details via a secure link, including address, DOB and to re-confirm their email address to allow fulfilment of the claim process. 
     

  1. If the winner cannot be contacted after 14 days of original notification, and after three attempts, or is unable to take their prize, rejects their prize or is ineligible, the prize entitlement will be withdrawn, and the prize will subsequently be awarded to a reserve winner selected at the time of the initial prize allocation. This process will continue until two reserves have been contacted after which the prize will be null and void. The prize will be despatched within 28 days of confirmation via email. Participants are encouraged to monitor their connections and Junk/Spam mail during this time in case they are a winner.  It is the members’ responsibility to ensure their email  details are correct and up to date.  

 

General  
 

 

  1. The Promoter is not responsible for the acts or default of third-party suppliers but will endeavour to resolve any issues that may arise. 

 

  1. The Promoter’s decision is final with regard to all promotional matters. 
     

  1. The winners will be subject to a full verification process. The winners may be asked to provide further information in order to verify their prize award including, but not limited to, asking for proof/confirmation of address and ID (passport, driving licence or equivalent).  
     

  1. All participants will be required to provide/confirm a genuine email address (which will be the Buxton Club/Newsletter email details) that is personal, valid, and accessible throughout the Promotion. In the event that the specified information is not provided or is incorrect, or has been deleted as membership has been cancelled, the email and thus access to the prize draw entry may be considered incomplete and therefore the Promoter reserves the right to invalidate the entry. 
     

  1. If an email address becoming inaccessible during the Promotion, the Promoter is not able to retrieve and amend any existing entries to a new email address. 
     

  1. Limitations of liability: Neither the Promoter, its agents or anyone professionally connected to the Promotion, assume any responsibility or liability for: 

  1. Any incorrect or inaccurate entry, or for any faulty, incorrect errors or failed electronic data transmissions; 

  1. Communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers, or providers utilised in any aspect of this Promotion; 

  1. Inaccessibility or unavailability of the internet or the microsite or any combination thereof.  

  1. Any systems failures on the website  
     

  1. The Promoter reserves the right to disqualify the participant where there are reasonable grounds to believe there has been a breach of these Terms and Conditions or any entry requirements or otherwise where a participant has gained unfair advantage in participating in the Promotion or won using fraudulent means. 
     

  1. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion or accepting or using the prizes, except for any liability which cannot be excluded by law (including personal injury, death and fraud) in which case that liability is limited to the minimum allowable by law. 
     

  1. The winners of the 12 month Headspace E-Gift cards’ surnames and counties of residence will be available by sending an email request to: [email protected] with ‘WINNERS LIST: BUXTON CLUB HEADSPACE E-GIFT CARD PRIZE DRAW’  in the subject line, for a period of three (3) months following the end of the Promotional Period. When contacting this email address, the request will be actioned in line with the Promoter’s Privacy Policy. The Promoter reserves the right to refuse any or all such requests. If any winner objects to their information being published, they can contact the Promoter by emailing [email protected] with the subject line ‘BUXTON CLUB HEADSPACE E-GIFT CARD PRIZE DRAW’. The Promoter nevertheless will disclose the information to the Advertising Standards Authority if required to do so.  

 

  1. If, for any reason, any aspect of this promotion is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter may in its sole discretion modify or suspend the promotion or invalidate any affected entries. If an act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these Terms and Conditions the Promoter will not be liable for any failure to perform or delay in performing its obligation but will always endeavour to minimise the effect to participants in order to avoid undue disappointment 
     

  1. If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these Terms and Conditions and the remaining clauses shall survive and remain in full force and effect. 
     

  1. The Promotion and these Terms and Conditions will be governed by the laws of the participating country and any disputes as to the meaning of these Terms and Conditions will be subject to the exclusive jurisdiction of the participant’s local courts. 

 

Data Protection 

  1. Winner selection and notification 

  1. One winner will be drawn at random within seven (7) working days of the closing date by an independent auditor from all valid and genuine entries.

Winner selection and notification 

 

  1. For the 122 daily prizes, winners will be randomly selected from all genuine, valid entries, every day via an independently verified computer process and the draws will take place on the days specified after the relevant daily entry date.  

  1. The three (3) Catch-all prize winners will be randomly selected via an independently verified computer process from all valid entries received during the Catch-all prize draw period. 
     

  1. The daily winners only will be notified on the draw date specified, via email to the email address provided on entry, to confirm/reconfirm entry details and complete the verification process by providing extra additional information such as proof of receipt for all entries and proof of address.  
     
    This claim process, i.e., requesting information and specifics to allow verification of the claim against the entry details will be received initially by email and a secure link and must be completed within 14 days of first notification in order for the winners to be verified to receive their prize.  
     
    Any prizes left unclaimed or rejected, or if after investigation a winner has been disqualified, will be forfeited and the Promoter reserves the right to re-allocate to a reserve winner, drawn next in line from the original draw. The process will be repeated, twice or until a further 28 days (14 days for each potential contact) after the initial draw date when despite reasonable attempts the prize will be forfeited. 

 

Once verified, the winning consumers will receive confirmation details that the prize is valid and then will be advised that their £250 Virgin Experience Days e-gift cards will be despatched via a further dedicated email. All prizes will be despatched within 30 days of the respective prizes being confirmed via email. The Catch–all and final prize draw winners will be contacted in the above manner with the final closing date of despatching any prize being a maximum of 14 days after this contact when a response hopefully will have been received from a winner or reserve (thus 14 days for the winner or each potential reserve contact to respond.) When the prize is despatched, winners should  allow 30 days for receipt of the prize. If no response is received from and after trying three (3) potential contacts and giving them 14 days to respond, then the prize will be withdrawn.  

 

  1. Winners will be subject to a full verification process. Winners may be asked to provide their promotional packaging and/or proof of purchase in order to verify their claim. 
     

  1. Participants are encouraged to monitor their connections and Junk/Spam mail during this time in case they are a winner.  

 

General 

 

  1. The entrant will receive no fees in relation to their entry into this promotion. Any and all costs incurred by obtaining time off from work or study to take part in the promotion or promotional prize are the responsibility of the winners.   1. If fulfilment or any element of this promotion is delayed or affected due to the continuing Covid-19 pandemic and resulting Government restrictions, any affected entrants will be contacted by the Promoter and kept updated of any unavoidable changes to the promotion or prize.  

 

  1. The Promoter is not responsible for the acts or default of third-party suppliers but will endeavour to resolve any issues that may arise.

  1. Proof of entry is not proof of purchase. Responsibility cannot be accepted for entries (or prize claims for that matter) that are lost, damaged or delayed, nor any associated costs to entrants.  

 

  1. All entrants will be required to provide a genuine email address that is personal, valid and accessible throughout the promotion. In the event that the specified information is not provided or is incorrect or an alias, the entry may be considered incomplete and therefore the Promoter reserves the right to invalidate the entry and cannot be held responsible for winners failing to supply accurate information which affects prize acceptance or delivery of their prize. 

  1. In the event of an email address becoming inaccessible during the promotion, the Promoter is not able to retrieve and amend any existing entries to a new email address. 

  1. Limitations of liability: Neither the Promoter, its agents or anyone professionally connected to the promotion, assume any responsibility or liability for: 

a. Any incorrect or inaccurate code entry, or for any faulty, erroneous or failed electronic data transmissions. 

b. Any unauthorised access to, or theft, destruction or alteration of codes at any point in the operation of this promotion. Communications line failure, regardless of cause, with regards to any equipment, systems, networks, lines, satellites, servers, computers or providers utilised in any aspect of this promotion.  

c. Inaccessibility or unavailability of the internet or the microsite or any combination thereof.  

d. Any unauthorised access to, or theft, destruction or alteration of codes at any point during the operation of this promotion.  

  1. Prizes are not transferable or exchangeable unless otherwise agreed in writing by the Promoter and cannot be redeemed for any other form of compensation. In the event for any reason the user does not take any element of the prize at the time stipulated by the Promoter, then that element of the prize will be forfeited by the user and no cash nor other form of compensation will be supplied in lieu of that element of the prize, unless otherwise agreed. 
     

  1. If, due to unforeseen circumstances, the prize is not available, the Promoter reserves the right to substitute another prize for it, in its sole discretion, of equal or higher value. 

 

  1. Conduct of entry: The Promoter reserves the right at its sole discretion to disqualify any entrant found to be tampering with the entry process or the operation of the promotion; or to be acting in any manner deemed by the Promoter to be in violation of the Terms and Conditions; or to be acting in any manner deemed by the Promoter to be disruptive.

If, for any reason, any aspect of this promotion is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter may in its sole discretion modify or suspend the promotion or invalidate any affected entries. If an act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these Terms and Conditions the Promoter will not be liable for any failure to perform or delay in performing its obligation but will always endeavour to minimise the effect to participants in order to avoid undue disappointment. 

  1. The Promoter reserves the right to verify all entries including but not limited to asking for address, purchase and identity details (passport, driving licence or equivalent)  which they must provide within 14 calendar days and to refuse to award a prize or withdraw prize entitlement, and/or refuse further participation in the promotion and disqualify the participant where there are reasonable grounds to believe there has been a breach of these Terms and Conditions or any instructions forming part of this promotion’s entry requirements or otherwise, where a participant has gained unfair advantage in participating in the promotion or won using fraudulent means. The Promoter will be the final arbiter for all decisions, which are final and binding. It will not respond to any correspondence.

The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion or accepting or using the prize, except for any liability which cannot be excluded by law (including personal injury, death and fraud) in which case that liability is limited to the minimum allowable by law. 

 

  1. If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these Terms and Conditions and the remaining clauses shall survive and remain in full force and effect. 

 

  1. The Promotion and these Terms and Conditions will be governed by the laws of the participating country and any disputes as to the meaning of these terms will be subject to the exclusive jurisdiction of the participant’s local courts.
