Terms and Conditions

 

Please read these terms and conditions carefully. They will govern the entry to take part in the Buxton® Here’s to Up and Coming Talent Retailer Competition (the “Promotion”).

 

  1. THE PROMOTER

 

  1. The promoter is Nestlé Waters, Nestlé UK Ltd, 1 City Place, Gatwick, RH6 0PA, United Kingdom.

 

  1. THE COMPETITION

 

  1. The title of the competition is “Buxton® Here’s to Up and Coming Talent Retailer Competition”
  2. Entrants must work within the convenience sector as a retailer
  3. Entrants must be UK based and over the age of 18
  4. Entrants must submit no more than 200 words as to why they deserve to win / or be nominated for the award
  5. The winning entry will be marked by a panel of judges against a selection of criteria, the winning individual will be the one who has created the greatest stand out with their passion and demonstrated their ability to go above and beyond within their chosen category/categories  

 

  1. HOW TO ENTER

 

    1. The competition will run from 9:00 on Monday 17th June 2019 (the “Opening Time) to 23:59 on Saturday 31st August 2019 (the “Closing Time) inclusive.

 

    1. All competition entries must be received by the Promoter via [email protected] by the Closing Time. All competition entries received after the Closing Date are automatically disqualified.

 

    1. To enter the competition:

 

  1. Entrant to submit a 200-word maximum written description as to why they feel they are excelling in any one of the three outlined categories

 

  1. The three categories outlined are as follows;
  1. Bottled Water Category;
    1. Dedicating the right amount of space in their chiller to bottled water (e.g. at least 20%)
    2. Clearly segmenting their offering and using signposting where relevant to make the category easy to shop for their customers
    3. Developing secondary siting and displays to drive impulse purchases
    4. Offering the right range of products and pack formats which respond to shopper missions, e.g. on-the-go, take home, with a meal
    5. Promotions e.g. breakfast, meal deals, mid-morning/afternoon snacking
    6. Anticipation of weather and events e.g. increasing bottled water offering during warm weather spikes
  2. Sustainability;
    1. Managing food waste
    2. Involvement in local environmental projects
    3. Packaging disposal
    4. Recycling facilities
    5. Supporting local initiatives e.g. foods banks/clothes recycling
    6. Health & nutrition (including hydration)
    7. Product sourcing and provenance
    8. Plans for improving the sustainability of their store in the future
    9. Store carbon/energy footprint e.g. use of renewable energy, zero waste to landfill
  1. Community;
    1. Partnerships with local charities
    2. Commitment to working with local businesses on shared local values
    3. Working with local authorities to improve the area
    4. Engaging with local schools and pupils
    5. Helping those less fortunate and protecting the vulnerable
    6. Tackling loneliness
    7. Delivering exceptional customer service to their community – going above and beyond
    8. Promoting positive health & nutrition (including hydration)
  2. Wider attributes to consider demonstrating include;
    1. A journey of self-improvement and discovery which mirrors that of Buxton and it’s ‘up and coming’ campaign messaging
    2. A clear demonstration of having shown determination and resilience
    3. A noticeable passion for retail and a forward-thinking mentality which comes across within the written entry and language used
    4. A well-rounded individual who looks at the benefit they can offer to others, as well as the success of their own work

 

 

  1. Entrant to send entry details to Promoter’s email address –[email protected]. The email must also contain:
  1. Entrant’s name and retail outlet/employer
  2. Name and location of store
  3. Contact telephone number
  4. Contact email address

 

  1. All entries must be uploaded by the Closing Time.

 

3.4 The Promoter will not accept:

 

  1. responsibility for competition entries that are lost, rebounded or blocked, regardless of cause, including, for example, as a result of any technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or

 

  1. proof of transmission as proof of receipt of entry to the competition.

 

3.5 By submitting a competition entry, you are agreeing to be bound by these terms and conditions.

 

3.6 The competition entries will be assessed by a panel of judges; the panel will consist of representatives from Nestlé Waters and partner organisations including; NFRN and HIM. The winner will be selected by Wednesday, 18th September 2019. The decision of the panel of judges (acting reasonably) will be final.

 

3.7 The Promoter will send the full names of the judges to anyone who writes within one month after the Closing Date of the competition requesting details of the judges and who encloses a self-addressed envelope to Cirkle, Canon House, 27 London End, Beaconsfield, Buckinghamshire, HP9 2HN.

 

  1. Eligibility

 

4.1 The competition is open to all retailers within the UK convenience channel (a convenience shop, store or corner store is a small retail business that stocks a range of everyday items such as groceries, snack foods, confectionary, soft drinks, newspapers and magazines), aged 18 years or over, except:

 

(a) employees of the Promoter or its holding or subsidiary companies;

(b) employees of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the competition or its administration; or

(c) members of the immediate families or households of (a) and (b) above.

 

4.2 In entering the competition, you confirm that you are eligible to do so and eligible to claim the prize. The Promoter may require you to provide proof that you are eligible to enter the competition.

 

4.3 The Promoter will not accept competition entries that are:

(a) automatically generated by computer;

(b) completed by third parties or in bulk;

(c) illegible, have been altered, reconstructed, forged or tampered with;

               (d) incomplete.

 

4.4 There is a limit of one entry per category. Multiple, or joint, entries within the same email will not be accepted.

 

4.5 The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize competition.

 

4.6 The Promotor reserves the right to share all invention entries according to our privacy policy, available here: https://www.nestle-waters.com/info/legal-information. No personal data of the entrant will be disclosed if the invention itself is shared, and explicit permission will be sought by The Promoter prior to the invention being shared on social media or any other platform.

 

  1. The Prize

 

5.1 The prize is:

  1. A 2 night weekend stay for two adults in Buxton (2 nights at the Old Hall Hotel in Buxton including dinner and breakfast for two consecutive days (includes one twin or double bedroom not two separate rooms)
  2. A £100 voucher for the Buxton Opera House
  3. An in-store water fixture makeover with a Nestlé Waters category expert, including free Nestlé Waters stock worth £200

 

5.2 The Promoter reserves the right to substitute the prize, in whole or part with a prize of equal or greater value. The prize does not include travel to or from the hotel, expenses incurred additionally during the stay or any drinks etc. charged to the room outside of the agreed mealtimes. Such costs will be at the winner’s own expense and will need to be settled by the winner with the hotel prior to departure.

 

5.3 The prize is supplied by Cirkle (the “Supplier”).

 

5.4 The prize is not negotiable or transferable and must be redeemed within 12 months of being awarded. Bookings are subject to availability and by mutual agreement with the Supplier and the hotel.

 

5.5 Dates for the winner’s hotel stay are subject to availability at the time of booking and will need to be agreed between the winner and the hotel at the time of booking.

 

  1. Winner Announcement

 

6.1 The winner of the competition will not be announced but interested parties can enquire as to who the winner was by contacting the team via the entry email address [email protected] for a period of up to 28 days from the end date of the competition.

 

6.2 The decision of the judges nominated by the Promoter is final and no correspondence or discussion will be entered into.

 

6.3 The Promoter’s agency (Cirkle) will contact the winner personally as soon as practical using the email address provided with the competition entry.

 

 

  1. CLAIMING THE PRIZE

 

7.1 The winner will be contacted via the email address provided on entry to confirm they have won, and must provide their name, contact number and postal address to organise prizes within 7 days of receiving the email notification. If the Winner fails to respond within that time, the Promoter reserves the right to select an alternative winner.

 

7.2 The prize may not be claimed by a third party on your behalf.

 

7.3 The Promoter will make all reasonable efforts to contact the winner. If the winner cannot be contacted or is not available, or has not claimed their prize within 7 days of receiving the notification, the Promoter reserves the right to withdraw the prize entitlement from the original winner and award it to the next best entry, in the opinion of the judging panel.

 

7.4 The Promoter does not accept any responsibility if you are not able to take up the prize.

 

  1. LIMITATION OF LIABILITY

 

Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.

 

  1. OWNERSHIP OF COMPETITION ENTRIES AND INTELLECTUAL PROPERTY RIGHTS

 

9.1 All competition entries and any accompanying material submitted to the Promoter will become the property of the Promoter on receipt and will not be returned.

 

9.2 By submitting your competition entry and any accompanying material, you agree to:

 

(a) assign to the Promoter all your intellectual property rights with full title guarantee; and

(b) waive all moral rights,

(c) in and to your competition entry and otherwise arising in connection with your entry to which you may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world.

 

9.3 You agree to grant the Promoter a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in the competition entry and any accompanying materials, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the competition entry and any accompanying materials for such purposes.

 

  1. DATA PROTECTION AND PUBLICITY

 

 

10.1 You further agree to participate in any reasonable publicity required by the Promoter.

 

10.2 By entering the competition, you agree to take part in trade publicity and that any personal information provided by you with the competition entry may be held and used only by the Promoter or its agents and suppliers to administer the competition. No personal data of the entrant will be disclosed without explicit permission being granted to The Promoter.

 

10.3 The Promoter will only use the personal details supplied by entrants for the administration of the promotion and the auditing of the entries where necessary and for no other purpose, unless we have your consent and you have opted-in to receive future marketing communications or prize PR. As part of this promotion, if you are not opted-in into our general marketing email, you will still receive emails for this promotion only to let you know if you have won. Your personal details will at all times be kept confidential, and in accordance with the General Data Protection Regulation (GDPR). You can request access to your personal data, or have any inaccuracies rectified, or request deletion of data by sending an email to: [email protected]. By participating in the promotion, you agree to the use of your personal data as described in our Privacy Policy. You can withdraw your consent at any time.

 

  1. GENERAL

 

11.1 If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the competition.

 

11.2 The Promoter reserves the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so.

 

11.4 Any person posting, or seen to be posting, comments to the ‘Buxton Water’ social media pages or elsewhere during the promotion that are considered bullying, spiteful or upsetting to other participants, or directly aimed at the Promoter, will have their comments removed and will be disqualified from the promotion. The Promoter reserves the right to alert Twitter to any such behaviour, which may result in the person’s account being frozen pending investigation.

 

11.5 Privacy Policy

As the terms of the promotion will be hosted via the Nestlé Waters website, their privacy policies will apply. See Clause 10.3 for the Promoter’s Privacy policy.

 

11.6. To ensure fairness and the integrity of the promotion to all participants, the Promoter will not enter into discussions regarding the running of this promotion via social media, but will respond to questions via [email protected]

 

11.7 The prize draw will be governed by UK law and entrants to the prize draw submit to the jurisdiction of the UK courts.
