BUXTON LONDON BIG HALF EVENT

Full Terms and Conditions:

These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry instructions are deemed to form part of these Terms and Conditions and by participating all participants will be deemed to have accepted and be bound by them. Participants should retain a copy for their information.

The Promoter takes data protection seriously. By entering this promotion, participants confirm that they have read the Promoter’s Privacy Policy and agree to these Terms and Conditions of the promotion. By submitting any information required as part of their participation into the campaign, participants agree to their information being held and processed in accordance with the General Data Protection Regulation (GDPR) and the Data Protection Act 2018.

ELIGIBILITY

1. This prize draw promotion is open to United Kingdom (England, Wales, Scotland, & Northern Ireland) residents aged 18 or over. Excludes employees and their immediate families of the Promoter, its affiliated companies, agents, or anyone else professionally connected with the promotion. 2. Internet access to the promotional site, and participant registration will be required for entry. Entry is via the London Big App only. Participants will require a smart phone and access to the internet.

3. No purchase necessary.

4. Maximum of one (1) entry per person. One (1) winner will win a place at the 2025 TCS London Marathon. Participants will be required to sign up Buxton’s CRM database and complete an entry form on the London Big Half App or website by no later than 23:59 on 01.09.24 to be included in the prize draw for a chance to win the prize.

5. Any entrant trying to circumvent the rules stated in these Terms and Conditions by using alternative details, setting up multiple accounts, using multiple identities, entering on behalf of others, or otherwise acting in a manner deemed by the Promoter to be in violation of the Terms and Conditions will be disqualified from this promotion.

6. Entries (bulk or otherwise) made from trade, consumer groups, agents, third parties or syndicates will not be accepted. If it becomes apparent that a participant is using a computer(s) to circumvent this condition by, for example, the use of programme, application, script, brute force, or any other automated means, that person’s claim(s) will be disqualified, and any prize awarded will be void.

Promotional Period:

7. The promotional period will be open to all valid entries, between 08:00 on 01.09.24 and 23:59 on the same day (01.09.24) only.

8. Entries cannot be made on any other dates or via any other method. All qualifying participants sign up to be added to the BUXTON Database to receive future marketing communications will automatically be added into the prize draw for a chance to win a place at the 2025 TCS London Marathon. Entry requirements

9. To enter for the prize draw, participants are required to:

• Visit the London Big Half App at https://www.thebighalf.co.uk.

• Follow the link to complete their personal details as requested, including: First Name, Last Name, Email address and Phone Number .

• Entrants will need to confirm they are over 18 and UK residents.

• Participants will have until 23:59 on 01.09.24 to complete an entry form via the London Big Half App.

• The winner will be drawn at random by an independent third party on 02.09.24.

• The winner’s details will be announced on the London Big Half App and website and the winner contacted on 04.09.24.

10. On submission of the entry into the prize draw, entrants will see an on-screen message confirming their entry.

11. All entries are subject to verification and interrogation. In the event of suspicious activity, the Promoter reserves the right to request evidence to confirm the legitimacy of the entry.

12. The Promoter takes no responsibility for entries delayed, incomplete or lost due to technical reasons or otherwise.

13. No duplicate entries will be accepted.

14. The Prize: The first entrant, drawn at random by an independent third party from all valid entries received by the stated closing time/date will be deemed the winner of a place in the 2025 TCS London Marathon due to take place on 27.04.25 in London, UK.

15. The winner will be required to follow the next steps via a secure claim form requesting further details, within two (2) days of being notified as a winner to confirm verification against the Terms and Conditions and to meet the necessary deadlines. All reasonable steps will be taken to contact the winner, but if this cannot be achieved within the allotted timescale detailed, or if there is any reason why the winner cannot compete at the event, then the Promoter reserves the right to cancel the win entitlement, withdraw the win and award the win to a reserve winner drawn at the same time as the original.

16. The Promoter will communicate via a secure link a route to allow the potential winner(s) to provide the Promoter information securely including address details, contact details, proof of age and proof of address.

17. The winners will be subject to a full verification process and will also have to adhere to the London Marathon’s terms of service as well found at https://www.tcslondonmarathon.com/enter/how-to-enter/general-conditions-of-entry.

18. To ensure the winner meets the correct protocols, the Promotor will need to provide the winning participant’s name and email address to the London Marathon which will generate an email for the winning participant. This needs to be actioned within strict timelines. Full details of the process will be shared with the winner. All details will be made available via the London Marathon, but if the winner has any concerns, they can get in touch with consumer.services@uk.nestle.com, or by telephone on Freephone 0800 00 00 30.

19. The prize is non-transferable. No cash alternatives will be offered in whole or in part. The Promoter nor the prize fulfilment partner cannot be held responsible for any elements of the prize cancelled or postponed due to elements outside of their control. Should this happen, the Promoter reserves the right to substitute the prize or any part of the prize for an item or experience of equal or greater value.

20. The winner will be drawn at random via an independently verified computer programme from all valid entries received by the stated closing date.

21. The draw will take place on 02.09.24 and the winner notified by 04.09.24.

22. In the event of an email address becoming inaccessible during the promotion, the Promoter is not able to retrieve and amend any existing entries to a new email address.

23. Inaccurate information may result in a prize being forfeited. Participants should retain their winning communication until the prize has been verified. Entrants are encouraged to monitor their email account during this time in case they are a winner including their Spam and Junk folders.

24. The Promoter will make reasonable efforts to contact the winner, however, if the winner has not responded to notification within fourteen (14) days and after three attempts, or if a selected winner is ineligible, or otherwise in breach of these Terms and Conditions, or unable to take up the prize for any reason, the prize entitlement will be withdrawn, and the prize will pass to a reserve winner drawn at the same time as the original winners. If the reserve winner cannot be contacted within 14 days and after three attempts, or cannot take up the prize, the prize entitlement will be withdrawn. The process will be repeated until a valid winner can be found from the reserves. However, if by 31.01.25, a prize has not been awarded then the Promoter reserves the right to cancel the prize completely and withdraw it from the promotion, as it may be too late to complete the registration process for the 2025 TCS London Marathon.

25. The Promoter will request confirmation the winners’ personal details via a secure link including their name, address, confirmation of their mobile number, proof of age and email address to assist with verification and fulfilment of their prize.

GENERAL

26. The Promoter shall have sole and final determination as to which entries are genuine and therefore eligible to take part in this promotion. The Promoter’s decision is final and binding with regards to all promotional matters.

27. The Promoter is not responsible for the acts or default of third-party suppliers including cancellation of the event but will endeavour to resolve any issues that may arise.

28. Limitations of liability: Neither the Promoter, its agents or anyone professionally connected to the promotion, assume any responsibility or liability for: i. Any faulty, incorrect, erroneous or failed electronic data transmissions. ii. Any unauthorised access to entry details at any point in the operation of this promotion. iii. Any difficulties in entering or claiming, any entries/claims delayed or corrupted or any loss arising out of such an event. iv. Communications line failure, regardless of cause, with regards to any equipment, systems, networks, lines, satellites, servers, computers, or providers utilised in any aspect of this promotion. v. Inaccessibility or unavailability of, the internet or any combination thereof. The Promoter cannot guarantee continuous, uninterrupted access to the microsite.

29. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion or accepting or using the prizes, except for any liability which cannot be excluded by law (including personal injury, death and fraud) in which case that liability is limited to the minimum allowable by law.

30. If, for any reason, any aspect of this promotion is not capable of running as planned, including by reason of infection by system virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter may in its sole discretion cancel, modify or suspend the promotion or invalidate any affected entries. If an act, omission, event, or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these Terms and Conditions the Promoter will not be liable for any failure to perform or delay in performing its obligation but will always endeavour to minimise the effect to participants in order to avoid undue disappointment.

31. The Promoter reserves the right to verify all entries including but not limited to asking for proof of address and age, which they must provide within fourteen (14) calendar days and to refuse to award a prize or withdraw prize entitlement, and/or refuse further participation in the promotion and disqualify the participant where there are reasonable grounds to believe there has been a breach of these Terms and Conditions or any instructions forming part of this promotion’s entry requirements or otherwise, where a participant has gained unfair advantage in participating in the promotion or won using fraudulent means.

32. By taking part in the promotion the prize winner agrees that the Promoter may contact them to ask for their consent as to whether they want to participate in reasonable marketing activities and publicity relating to the promotion. Such publicity may include, without limitation, the entrants’ name and/or if consent given, image or statements made by entrants concerning the promotion and/or prize obtained as part of the promotion. The winner is not obliged to agree to any such request.

33. Subject to the Promoter’s Privacy Policy, the winner’s surname and county of residence will be available by sending an email request to: consumer.services@uk.nestle.com with: ‘WINNER’S LIST: BUXTON LONDON BIG HALF PRIZE DRAW’ in the subject line, for a period of three (3) months following the closing date of the promotion. When contacting this email address, requests will be actioned in line with the Promoter’s Privacy Policy and the Promoter reserves the right to refuse any or all such requests. If any winner objects to their information being published, then they can contact the Promoter by emailing UKI.dataprotection@uk.nestle.com with the subject line ‘BUXTON LONDON BIG HALF PRIVACY REQUEST’. The Promoter may nevertheless disclose the information to the Advertising Standards Authority if required to do so.

34. If any of these clauses should be determined to be illegal, invalid, or otherwise unenforceable then it shall be severed and deleted from these Terms and Conditions and the remaining clauses shall survive and remain in full force and effect.

35. The Promotion and these Terms and Conditions will be governed by the laws of the participating country but any disputes as to the meaning of these Terms and Conditions will be subject to the exclusive jurisdiction of the participant’s local courts.

Data Protection

36. The Promoter will only use the personal details supplied for the administration of the promotion and the auditing of the entries where necessary and for no other purpose, unless we have your consent/you have opted-in to receive future marketing communications. The surnames and counties of residence of verified winners will be made available as set out in the relevant clause above and the winner(s) can object to this by emailing UKI.dataprotection@uk.nestle.com. Otherwise, your personal details will at all times be kept confidential and in accordance with the General Data Protection Regulation (GDPR) and the Data Protection Act 2018 as applicable. By participating in the promotion, you acknowledge to the use of your personal data as described here. You can withdraw your consent at any time. For the purpose of this promotion, requests to delete personal data can only be actioned after the promotion has concluded and the winner(s) accepted their prize. Any data obtained via this promotion will be deleted three (3) months after the promotion end date with the exception of the winner(s) and reserve(s) whose data will be deleted after fulfilment of the prize(s).
